HOURS AFTER 🦀 DONALD TRUMP WITNESS TAMPERED IN REAL TIME, ROGER STONE FOUND GUILTY OF THE SAME CRIME

November 15, 2019/15 Comments/in 2016 Presidential Election, 2020 Presidential Election, Impeachment, Mueller Probe /by emptywheel

In the middle of today’s impeachment testimony from 🦅 Marie Yovanovitch 🦀 Trump lost control of his emotions and attacked the witness.

Adam Schiff interrupted committee counsel Dan Goldman’s questioning, read Yovanovitch the tweet, and asked her how it made her feel.

Yovanovitch said it made her feel intimidated.

Schiff, a former federal prosecutor, knows how to substantiate a witness tampering charge. Even Bret Baier recognized this as such.

During the break in Yovanovitch’s testimony, the jury in Roger Stone’s trial came back with a verdict. They found him guilty on all seven counts. That includes a witness tampering charge for Stone’s efforts to dissuade Randy Credico from testifying before the House Intelligence Committee, the very same committee leading this impeachment hearing.

The courts are just now imposing consequences for Trump’s efforts to cheat to win the 2016 election, even as he attempts to prevent the 🦅 one court that can try him for imposing consequences for cheating to win the 2020 election.

Roger Stone guilty on all counts in federal trial of lying to Congress, witness tampering
Source: Washington Post

A federal jury has convicted longtime Trump confidant Roger Stone of lying to Congress and tampering with a witness about his efforts to learn about the anti-secrecy group WikiLeaks release of hacked Democratic emails in the 2016 U.S. presidential election. The panel of nine women and three men deliberated for less than two days before finding Stone, 67, guilty on all seven counts resulting from his September 2017 testimony to a House intelligence committee investigating Russian interference in the 2016 election and the Kremlin’s efforts to damage Trump’s Democratic opponent, Hillary Clinton. Stone, in a blue suit, stood at the defense table with his left hand in his pants pocket, watching impassively as verdicts were read.

Stone had argued that he was not intentionally dishonest and that the cases was politically motivated. But jurors sided with prosecutors who said Stone obstructed the House efforts because the truth would be embarrassing to Donald Trump’s campaign. Stone’s indictment was the last brought by special counsel Robert S. Mueller III, putting on trial his slippery brand of political brawling and revealing important new details about the Trump campaign’s keen interest in computer files hacked by Russia and made public by WikiLeaks.

He was accused of lying to Congress and tampering with a witness, an associate prosecutors said Stone threatened in a bid to prevent the man from cooperating with lawmakers.Though prosecutors sought to prove only that Stone had lied to Congress, they asserted that his motive for the falsehoods was protecting Trump from embarrassment — and thus made the president and his campaign a key component in their case.

Stone’s trial reenergized discussions of Russian interference in the 2016 election and occurred alongside public hearings in Democrats’ impeachment inquiry into whether the president tried to pressure his Ukrainian counterpart to investigate a potential 2020 opponent, former Vice President Joe Biden. In arguments and testimony over the past two weeks, prosecutors revealed a series of phone calls at critical times in 2016 between Stone, Trump and some of the highest-ranking officials on the Trump campaign — Stephen K. Bannon, Paul Manafort and Rick Gates.

It sure sounds like Rudy Giuliani is openly threatening Donald Trump

Bill Palmer | 10:00 pm EST November 14, 2019
Palmer Report » Analysis

Facebook ShareTwitter ShareEmail this articlePrint Article
Rudy Giuliani appears to have concluded that the only way for him to get out of the hole he’s dug for himself is to keep digging. So even though he’s on the verge of arrest, and he further incriminates himself nearly every time he opens his mouth, he’s still doing interviews. Here’s the thing, though: he just threatened to take Donald Trump down with him.

In a bizarre new interview, Rudy Giuliani was asked by The Guardian if he worries that Donald Trump will “throw him under a bus.” Rudy’s response: “I’m not, but I do have very, very good insurance, so if he does, all my hospital bills will be paid.” Wait, what? To give you an idea of how off-the-rails this answer was, Rudy’s new lawyer – who was on the phone line with him – immediately jumped in and insisted that Rudy was “joking.”

Here’s the thing. There are a couple different ways to parse this. Some will read this quote as Rudy saying that he has good health insurance, but we see that as too far out of context for what Rudy was talking abut. Our take is that he’s saying he has “insurance” against Trump, because he knows where all the proverbial bodies are buried in Trump’s various scandals. To be clear, this wasn’t a mere joke. It’s not the kind of thing you “joke” about in public unless you’re trying to send a message and you’re using humor to give yourself a sliver of deniability.

It’s really difficult to read this remark as anything other than Rudy Giuliani openly threatening Donald Trump. Rudy is clearly looking for a pardon from Trump. But that would only save him on federal charges, and there’s little doubt that New York would bring parallel state charges if a federal pardon happens.

It would also be very difficult for Donald Trump to pardon Rudy Giuliani. For one thing, it would be politically disastrous for Trump, at a time when Senate Republicans are begging Trump not to take things to such a villainous extreme that they end up having to selfishly oust him. In addition, it would likely trigger a court battle over whether a president can pardon his alleged co-conspirators. If that ruling went poorly for Trump, he could lose his ability to pardon his family on his way out the door. Yet Rudy is reminding Trump that he has “insurance” if no pardon comes.

CNN has the opening statement from the Holmes testimony (the staffer who heard the telephone call in the Kiev restaurant). It's damning...Trump only cared about the Big stuff, which turns out to be not the war, but the investigation into Biden. Honest! Tomorrow is the Office of Budget guy who had to first sign off on the hold...then, might have said it might be illegal and was replaced by a political appointee.

Democrats invite Trump to testify in impeachment inquiry
Source: Associated Press

By JILL COLVIN

WASHINGTON (AP) — Democratic House Speaker Nancy Pelosi invited President Donald Trump to testify in front of investigators in the House impeachment inquiry ahead of a week that will see several key witnesses appear publicly.

Pushing back against accusations from the president that the process has been stacked against him, Pelosi said Trump is welcome to appear or answer questions in writing, if he chooses.

“If he has information that is exculpatory, that means ex, taking away, culpable, blame, then we look forward to seeing it,” she said in an interview that aired Sunday on CBS’s “Face the Nation.” Trump “could come right before the committee and talk, speak all the truth that he wants if he wants,” she said.

Senate Democratic leader Chuck Schumer echoed that suggestion.

“If Donald Trump doesn’t agree with what he’s hearing, doesn’t like what he’s hearing, he shouldn’t tweet. He should come to the committee and testify under oath. And he should allow all those around him to come to the committee and testify under oath,” Schumer told reporters. He said the White House’s insistence on blocking witnesses from cooperating begs the question: “What is he hiding?”

🦅 Adam Schiff takes a blowtorch to 😈 Mick Mulvaney
Bill Palmer | 2:00 pm EST November 17, 2019
Palmer Report » Analysis

On Saturday, OMB official Mark Sandy broke ranks and testified behind closed doors to the House impeachment inquiry. This was a major blow to Donald Trump, as Sandy was involved with the money trail in the Ukraine extortion scandal. It was an even bigger blow to Mick Mulvaney, who is still the OMB Director in addition to being Trump’s Acting White House Chief of Staff.

Mick Mulvaney now has a problem, because after he publicly confessed to Donald Trump’s quid pro quo, he refused to come in and explain things to the House impeachment inquiry – and now one of his underlings has done it for him. Now that Mulvaney’s window of opportunity to come in from the cold has come and gone, House Intelligence Committee Chairman Adam Schiff is taking a blowtorch to him.

Adam Schiff released a statement calling out Mick Mulvaney for refusing to testify, and for trying to block others like Mark Sandy from testifying. Schiff then added this: “This is the same Mick Mulvaney who publicly admitted from the White House podium that Trump withheld the military aid in order to pressure Ukraine to conduct investigations meant to help the President’s re-election campaign, and the same Mick Mulvaney who was a direct firsthand participant in and witness to the scheme.”

We suspect Adam Schiff is zeroing in on Mick Mulvaney right now as a way of signaling to him that he’s been fully nailed by the testimony of Mark Sandy and others. It’s difficult to imagine a scenario in which Mulvaney doesn’t go to prison after Trump is gone, and Schiff appears to be letting Mulvaney know that his time is up to cut a plea deal.

Jonathan Chait: Pretending Trump Wants to Stop Corruption Is the 🐘GOP’s Most Insulting Lie Yet

And now Republicans have arrived, at last, at their final defense. Sure, President Trump may have demanded Ukraine investigate his domestic rivals, and sure, there may have been some kind of conditional that-for-that trade that could be summarized in a Latin phrase. But it’s all okay because Trump was trying to root out corruption. He said so himself.

Trump’s ask to investigate “corruption” in Ukraine was structured specifically around a demand for a public announcement of an investigation. Why does it have to be public, if Trump just wanted Ukraine to look into misconduct? Because, obviously, he wanted the “investigation” to generate news that would implicate the FBI and the Bidens. Also, if Trump was concerned about “corruption,” it seems like a weird choice to deputize as his investigators a couple of crooks tied in with the Russian mafia, who were also looking to make themselves some money while they “uncovered corruption.”

Indeed, 🦀 Trump himself makes it perfectly clear that “corrupt” is simply a label he uses to describe his political opponents. He has called Nancy Pelosi and Adam Schiff “corrupt.” He has described the entire Democratic Party as corrupt (“Tomorrow you will vote to reject the Democrats’ extremism, socialism, and corruption,” he promised rallygoers before Tuesday’s elections). He has used the phrase for several members of the FBI, the mainstream media, Hillary Clinton, Barack Obama, and on and on.

Republicans are a little squeamish about openly saying, “Trump can push foreign countries to investigate his rivals.” Instead they say, “Trump can push foreign countries to investigate corruption.” But these two statements mean the exact same thing. The notion that Trump’s activity had any relation to legitimately trying to root out corruption is the biggest insult to our intelligence so far.
