Jeff Flake: 'At least 35' GOP senators would vote to remove Trump if vote was private

WASHINGTON — Former Republican Senator Jeff Flake said that he thinks at least 35 Republican senators would vote for President Donald Trump to be removed from office if they could vote in private.

Speaking at the 2019 Texas Tribune Festival Thursday, Flake was responding to comments made by Republican political consultant Mike Murphy on MSNBC who said that if there was a secret vote, at least 30 GOP Senators would back impeachment.

“That's not true. There would be at least 35," Flake said.

Perhaps one of the biggest hurdles with bringing impeachment to the table has been to convince the average person who doesn’t follow politics that the process isn’t being carried out simply for partisan reasons. After all, that was largely why Republicans decided to waste time with an impeachment effort they knew was doomed to fail back in 1998, and why the previous two U.S. presidents were routinely threatened with articles of impeachment that never came to fruition. Republicans took what was meant to be a bipartisan action to remedy a constitutional crisis and made it into a partisan tool.

Impeachment shouldn’t be the first option under any president, regardless of how much you agree or disagree with their politics. It’s an arduous process that can divide the country and erode the trust people have in democratic institutions for years to come, whether or not it’s effective. Unfortunately, much of the Trump presidency has been defined by his administration’s disregard for these institutions meant to provide checks and balances, and impeachment is a last resort option to discourage any future politicians from seeking foreign aid to swing an election in their favor.

Now, the effort to impeach Donald Trump has gotten a significant boost from a non-partisan source: a watchdog organization known as National Security Action has publicly come out in favor of impeachment on Friday morning, releasing a statement that lauded the efforts of House Democrats and collected the signatures of 300 former national security advisors who worked under both Democratic and Republican administrations. Even more former advisers are expected to sign the document in the next few days.

“President Trump appears to have leveraged the authority and resources of the highest office in the land to invite additional foreign interference into our democratic processes,” the letter reads. “That would constitute an unconscionable abuse of power. It also would represent an effort to subordinate America’s national interests — and those of our closest allies and partners — to the President’s personal political interest.”


Donald Trump is probably presiding over the least stable National Security Council in history, with advisers rarely staying on past a year. If the letter is any indication, we may be seeing a flurry of ugly news leaking soon about this administration’s reckless foreign policies.

In a sign of just how much of a career criminal Donald Trump is, and a sign of just how chaotic the circus surrounding Trump’s failing presidency has become over the past week, it turns out he committed a felony in plain sight yesterday – and it went barely noticed.

Yesterday morning, a Senate committee report labeled the NRA a “foreign asset” of the Russian government. The money trail running from the Kremlin, through the NRA, to the 2016 campaigns of Donald Trump and a huge number of other Republicans, has been so thoroughly exposed that the NRA’s continued existence is in doubt and its leaders are in danger of ending up criminally indicted. So you’d think that, even as Trump is being impeached for trying to criminally conspire with foreign nations, he’d want to steer clear of the Russian puppets in the NRA – particularly yesterday of all days.

But don’t tell that to Donald Trump, who never met a crime he didn’t like. Yesterday, Trump met with NRA boss Wayne LaPierre and offered not to pursue any gun legislation if the NRA was willing to finance  his impeachment defense, according to the New York Times. Congressman Ted Lieu , a former prosecutor, tweeted precisely why this is a crime: “If the [New York Times] article is accurate, it appears Donald Trump seeks to trade action on legislation in exchange for financial support from the NRA. That would be illegal. A felony, to be exact.”

In other words, Donald Trump has reached the point of desperation where he’s now committing even more crimes in the name of trying to get himself off for his existing crimes. When the House starts introducing and then eventually expanding articles of impeachment, Trump’s NRA felony will surely end up being one of them. In addition, once Trump is ousted, the NRA felony will get him criminally indicted on yet another felony. Trump is never, ever getting out of prison.

In private, many Republicans are in crisis mode over Trump’s scandal in Ukraine, reportedly claiming that an impeachment inquiry could permanently derail his presidency. One Senate Republican told the Washington Post that releasing the limited transcript of Trump’s call to Ukrainian President Volodymyr Zelenksy was a “huge mistake.” One former administration staffer told Politico that, due to the scandal, the remainder of Trump’s legislative agenda “probably doesn’t get done.” Another prominent Republican told Vanity Fair that “this could unwind very fast, and I mean in days.”

Though there’s turmoil under the surface, in public the GOP amidst Trump’s impeachment inquiry is having a much quieter crisis, as Republicans weigh in with responses ranging from it “raises a number of important questions”but we’re not going to do anything, to “Biden is the one who threatened Ukraine’s aid, not Trump.” And as the party goes, so does its organ. According to a new report from Vanity Fair’s Gabriel Sherman, Fox News is grappling with how to deal with Trump’s worsening Ukraine scandal and the developing impeachment inquiry. On Thursday morning, Sean Hannity reportedly told friends that the whistle-blower’s report is “really bad,” and that Fox Corporation CEO Lachlan Murdoch is considering how to set up the network for its inevitable post-Trump future. But unlike the party at-large, the turbulence is being felt a little more publicly. As Sherman reports:

Fox has often taken a nothing-to-see-here approach to Trump scandals, but impeachment is a different animal. “It’s management bedlam,” a Fox staffer told me. “This massive thing happened, and no one knows how to cover it.” The schism was evident this week as a feud erupted between afternoon anchor Shepard Smith and prime-time host Tucker Carlson. It started Tuesday when Fox legal analyst Judge Andrew Napolitano told Smith on-air that Trump committed a “crime” by pressuring Ukraine’s president to get dirt on Biden. That night, Carlson brought on former Trump lawyer Joe diGenova, who called Napolitano a “fool” for claiming Trump broke the law. Yesterday, Smith lashed back, calling Carlson “repugnant” for not defending Napolitano on air. (Trump himself is said to turn off Fox at 3 p.m., when Shep Smith airs.) Seeking to quell the internecine strife before it carried into a third day, Fox News CEO Suzanne Scott and president Jay Wallace communicated to Smith this morning to stop attacking Carlson, a person briefed on the conversation said. “They said if he does it again, he’s off the air,” the source said. (Fox News spokesperson Irena Briganti denied that management had any direct conversation with Smith).

Another gem from the report: Paul Ryan, who joined the Fox board a few months after his retirement, is among those at the network pushing for hosts to break with the president. “Paul is embarrassed about Trump and now he has the power to do something about it,” an executive close to Ryan said — as if he has more power to check Trump’s authoritarian tendencies as a TV board member than he did as Speaker of the House.

But having an adverse relationship with holding the president accountable appears to be a theme among Republican lawmakers:

Speaker Nancy Pelosi (D-Calif.) accused Attorney General William Barr on Friday of going "rogue" in his efforts to protect President Trump from the fallout over a whistleblower complaint related to Trump's conversations with the president of Ukraine.

During an interview with MSNBC's "Morning Joe," Pelosi argued that Barr was part of a White House "cover up" of Trump's call to Ukraine's Volodymyr Zelensky, during which Trump asked Zelensky about the possibility of launching an investigation into former Vice President Joe Biden.

"He's gone rogue," Pelosi said. "I think where they're going is a cover-up of a cover-up."

"I think it's sad, to have a Justice Department go so rogue," she continued. "Well, they have been for a while. And now it just makes matters worse."

President Donald Trump on Monday suggested that House Intelligence Committee Chairman Adam Schiff could face “arrest for treason” over his recent statement about Trump’s call with Ukraine’s president.

“Rep. Adam Schiff illegally made up a FAKE & terrible statement, pretended it to be mine as the most important part of my call to the Ukrainian President, and read it aloud to Congress and the American people,” Trump tweeted.

“It bore NO relationship to what I said on the call. Arrest for Treason?” he added.

Neither the White House nor a spokesman for Schiff, D-Calif., immediately responded to CNBC’s request for comment on the president’s tweet. The fiery tweet accusing Schiff — a leading voice on the House’s impeachment inquiry into Trump — of “illegally” misrepresenting him came days after the president said at a private staff event that “we used to handle” spies and treason “a little differently than we do now.”

GOP Congressman Will Plead Guilty in Insider-Trading Case

Rep. 😈 Christopher Collins, a Republican from New York, is pleading guilty to insider trading.

The congressman was charged last year with trading on non-public information about Innate Immunotherapeutics Ltd., an Australian biotechnology company. He was arrested in August 2018 along with his son, Cameron Collins, and Stephen Zarsky, the father of Cameron’s fiancee. All have pleaded not guilty.

Rep. Mac Thornberry becomes sixth Texas Republican in House to announce retirement ahead of 2020

Clarendon Rep. Mac Thornberry on Monday announced that he will not run for reelection next year, making the 13-term lawmaker the sixth Texas Republican in Congress to head for the exits ahead of the 2020 election.

"We are reminded, however, that 'for everything there is a season,' and I believe that the time has come for a change," he said in a news release, saying that it's been a "great honor" to serve the people of his district. "Therefore, I will not be a candidate for reelection in the 2020 election."

His retirement marks a heavyweight loss for a state GOP delegation in flux. The Panhandle native, elected to the U.S. House in 1994, is one of the longest-tenured Texans in Washington from either party. He's spent the last three terms as the top Republican on the powerful House Armed Services Committee, serving as chairman for two of those terms.

However, whether she admits it or not, I maintain that she is NOT a happy camper when it comes to Trump's tariff war with China. She LOVES China. Her Chinese connections MADE HER RICH! Do you think that has gone away? Do you think MONEY is no longer NUMERO UNO for her? Neither do I. I am convinced that she is quietly convincing her husband that it is time for Mr. Trump to go away.

I believe that Moscow Mitch is surreptitiously trying to take Trump down in order to prevent the loss of a  Republican Party majority and the Right wing Swamp Creatures 'R' US influence in U.S. foreign and domestic policies. 

The "Civil War" Trump is "warning" about is just more Trump psychological projection. 

The ACTUAL Civil War is the one going on within the 🐘 Republican  Party. It has nothing to do with ethics or principle or preserving the rule of law; it's about the realization among around 30% of those crooks and liars that they need to dump Trump in order to retain their (fraudulently orchestraded) "legitimacy" in the public eye.

China wants Trump to go away. China is using all of its considerable influence in U.S. politics () to get Trump dumped.

All China wants is 😈 business as usual oligarchic corruption in the USA. So, they will favor letting Trump go with a slap on the wrist . The USA is TOAST if we do not put Trump and his ENTIRE wrecking crew, and his enablers in the media, and his enablers in the House and the Senate, in prison . So, while I welcome China's repudiation of Trump, don't you believe for one second that just because Trump is no longer in office, everything's gonna be nice.

This craven, cowardly, buck passing, future WORSE corruption fostering BULLSHIT that Ford, Carter, Clinton AND Obama pulled in refusing to jail the treasonous bastard Republican Presidents and their coterie of murderous crooks and liars has GOT TO STOP NOW.

Numerous actions and events have brought us to this impeachment precipice, virtually all of them initiated by Trump himself. He is the architect of his own demise, and there is no turning back.

As of Saturday, some 225 members of the House of Representatives were on record endorsing an impeachment investigation. Their ranks included independent Justin Amash of Michigan and Republican Mark Amodei of Nevada. The last high-profile House Democratic holdout, Tulsi Gabbard of Hawaii, announced her support Friday. The total will only expand in the coming weeks.

Trump, for his part, appears increasingly exhausted, paranoid and incoherent, not unlike Richard Nixon in the final stages of Watergate. The president has taken to Twitter even more than usual, spewing vitriol and blurting out threats of revenge against his many presumed enemies.

For those who are unfamiliar with the procedure or who could simply use a refresher, impeachment is the constitutional mechanism by which a president, vice president or “civil officer of the United States” can be accused of “treason, bribery or other high crimes and misdemeanors” and removed from office upon conviction.

The specific provisions governing the process can be found in Article 1, Section 2 and Article 2, Sections 3 and 4 of the Constitution, which define the respective powers of the legislative and executive branches of the federal government.

Together, the provisions establish a two-step process. As explained in a 2015 study, “Impeachment and Removal,” prepared by the nonpartisan Congressional Research Service: “First, a simple majority of the House impeaches—or formally approves allegations of wrongdoing amounting to an impeachable offense, known as articles of impeachment. The articles of impeachment are then forwarded to the Senate where the second proceeding takes place: an impeachment trial. If the Senate, by vote of a two-thirds majority, convicts the official of the alleged offenses, the result is removal from office. …” [Emphasis in original]

Although scores of federal officials have been the subject of congressional impeachment resolutions since the nation’s founding, the House has referred only 19 individuals to the Senate for impeachment trials—15 federal judges (including Supreme Court Justice Samuel Chase in 1805), one senator, one cabinet member and two presidents, Andrew Johnson in 1868 and Bill Clinton in 1998-99. The Senate has conducted 16 impeachment trials, convicting eight lower-court judges. The rest were acquitted.

Nixon, whose name is most often associated with impeachment, was never formally impeached. Rather than face certain conviction in the Senate, Nixon resigned before the full House could vote on three articles of impeachment passed by the Judiciary Committee in 1974.

As the accusatory body, the House has the authority to decide what constitutes an impeachable offense in any particular instance. The Constitution provides only general guidance, defining the grounds for impeachment as “treason, bribery and other high crimes and misdemeanors.”

While treason and bribery are clear enough, to grasp the meaning of “high crimes and misdemeanors”—the basis most commonly invoked over the decades and which will surely be cited against Trump—we have to look back to the Constitutional Convention of 1787.

The Founding Fathers debated impeachment and the notion of high crimes and misdemeanors extensively at the convention. James Madison described impeachment as “indispensable . . . for defending the community [against] the incapacity, negligence or perfidy of the chief magistrate.” George Mason argued, “No point is of more importance than that the right of impeachment should be continued. Shall any man be above justice?” Benjamin Franklin quipped dryly that impeachment was preferable to the European method of displacing a king—assassination.

But of all the Founders, Alexander Hamilton is credited with defining the scope of impeachment. In Federalist (Paper) No. 65 (1788), Hamilton described the legal process as embracing not only overt criminal conduct, but also serious violations of the “public trust.”

True to Hamilton’s reasoning, over the course of our history, charges of high crimes and misdemeanors have been alleged for a wide array of wrongdoing, both criminal and noncriminal, including abuse of power, obstruction of justice, corruption, bribery and perjury.

No one, not even Nixon, is more deserving of impeachment than Donald John Trump. In 2015, while Trump was a presidential candidate, I warned of the dangers he posed to immigrants, the First Amendment, and civil rights and liberties in general. Soon after the election, I began writing about his inevitable impeachment.

The principal debate now among mainstream Democrats and progressives is no longer whether Trump should be impeached, but how extensive the articles drafted against him should be. Well before the Ukraine scandal erupted into public view last week courtesy of a whistleblower’s complaint, Trump was liable for a long laundry list of impeachable offenses. Among the many derelictions I have cited, Trump can credibly be accused of:

Committing campaign finance violations by paying hush money to two women with whom he allegedly had extramarital affairs, Karen McDougal and po rn star Stormy Daniels;
Obstructing justice in connection with the investigation by special counsel Robert Mueller;
Defying congressional subpoenas;
Using the presidency for personal economic gain;
Abusing the pardon power to reward political allies;
Attacking the press and the judiciary;
Threatening to prosecute political opponents;
Abusing emergency powers to build his border wall;
Incarcerating undocumented immigrant children in concentration camps;
Attempting to strip millions of Americans of health insurance;
Promoting tax reform to benefit the super-rich;
Gutting environmental regulations and pulling out of the Paris climate accord;
Refusing to enforce the Voting Rights Act; and
Curbing the use of federal consent decrees to counter police misconduct.


The mafia-like shakedown of Ukraine President Volodymyr Zelensky—as reflected in the declassified “Memorandum of Telephone Conversation” (memcon) that details the July 25 conversation between the leaders—only adds fuel to an already raging fire.
