Federal judge says Donald Trump can be indicted while he’s still in office

When Federal Judge Victor Marrero ruled this morning that Donald Trump’s tax returns must be turned over to the Manhattan District Attorney, he issued a wide-ranging ruling that covered a lot of ground. As Palmer Report explained, the legal battle centers around a grand jury subpoena over the tax returns, which means the grand jury is seeking to criminally indict Trump on state charges. It turns out the judge had something to say about when Trump can be indicted.

The big question about the New York grand jury is whether it’ll wait and indict Donald Trump the minute he’s no longer president (at which point he’d be immediately arrested), or if the grand jury will try to indict Trump while he’s still in office. Donald Trump’s Department of Justice is insisting that a sitting president can’t be indicted on federal charges – but the DOJ doesn’t have direct control over what the states can do. That’s why the judge’s ruling this morning is so crucial.

As flagged by a number of observers, the judge said in his ruling the DOJ’s position on not indicting a sitting president is essentially nonsense. We all know that the DOJ isn’t going to indict Donald Trump while Bill Barr is still running it. But the judge just handed significant legal precedent to New York State if it decides to try to indict Trump while he’s still in office.

We still don’t know what that would look like. Federal law enforcement probably won’t allow New York State to arrest Donald Trump while he’s still president. But if he’s indicted and he refuses to show up for his trial, it could be held without him. If he’s convicted, and the sentence includes asset seizures, that could begin while he’s still in office. It’s New York’s move now – but this ruling supercharges things.

National security officials start leaking the ugly details of Donald Trump’s bizarre Turkey-Syria stunt in real time

It’s not entirely clear why Donald Trump has suddenly decided to hand Northern Syria to Turkey. Maybe he’s putting the lives of the Kurds in jeopardy as a bargaining chip in his inevitable resignation plea deal. Maybe Turkey paid him off in a quid pro quo. Or maybe Trump is just trying to hurry up and finish himself off. One thing is clear: his own national security people aren’t having any of it, and they’re leaking things in real time.

One national security official is telling Newsweek Donald Trump got “rolled” in his deal with the head of Turkey, and that Trump “has no spine.” Someone else close to the situation is telling Politico that Trump has gone “rogue.” This all adds up to one thing.

We’re now past the point of people in the Trump administration filling out whistleblower reports about Donald Trump’s anti-American antics, and then going through the long process of waiting for their report to go through the proper channels. We’re now at the point where national security officials are taking the risk of picking up the phone, calling reporters, and spelling out precisely what Trump is doing, within hours of him having done it. These people deserve major credit for doing so.

Meanwhile, Donald Trump is taking heat from all sides for his bizarre and treacherous move on Syria and Turkey. Republican Senators including Mitt Romney and (surprisingly) Lindsey Graham :o ;D are calling it a “disaster.” It appears Trump’s stunt is only serving to accelerate his own inevitable downfall.

McConnell joins other 🐘 Republicans 👀 in rebuking 🦀 Trump's Syria withdrawal ;D

Senate Majority Leader Mitch McConnell publicly rebuked President Trump’s plan to withdraw U.S. troops from northeast Syria, saying that a supermajority in the Senate disagreed with the president’s abrupt announcement.

“I urge the President to exercise American leadership to keep together our multinational coalition to defeat ISIS and prevent significant conflict between our NATO ally Turkey and our local Syrian counterterrorism partners,” McConnell said Monday in a statement. “Major new conflict between Turkey and our partners in Syria would seriously risk damaging Turkey’s ties to the United States and causing greater isolation for Turkey on the world stage.”

McConnell’s statement echoes the comments of several other Republicans who have condemned Trump’s decision to withdraw troops from Syria’s border with Turkey. Several senators said that Trump’s move would abandon U.S.-allied Kurdish fighters ahead of a long-threatened Turkish offensive into northern Syria.

New Poll Shows Nearly 60 Percent of Americans Support Trump Impeachment Inquiry

Fox News poll: 51 percent favor 🦀 Trump's impeachment 👀 and removal from office

A new poll released Wednesday by Fox News shows that just more than half of all registered voters support President Trump's impeachment and removal from office.

Those surveyed said 51% to 43% that Trump should be impeached and removed from office. Four percent said he should be impeached but not removed from office, and 40% said he should not be impeached at all.

The poll also showed a clear partisan divide. Of Democrats surveyed, 85% said Trump should be impeached and removed, as did 13% of Republicans. Those opposed to impeachment and removal included 9% of Democrats and 82% of Republicans.

This poll is among the first to show that roughly half of Americans support impeachment and removal from office. It lines up with a Politico/Morning Consult survey also released Wednesday that said support for removal was at 50%.
