The main function of the U.S. Supreme Court is, in general, to provide fascist elite orchestrated impunity for just about any sort of injustice visited on the populace in order to continuously enrich criminal elites in particular.
I think you have it exactly right. All of the major incursions against democracy have been fashioned by the Court, starting with "corporate personhood," recently bookended by "money=speech." A retrograde court can go where democratically elected representatives cannot.
