People are Winning’ -- Oil Hub First in US to Ban 🦕 Fossils

The Whatcom County Council in Washington state has unanimously passed permanent land-use policies that ban new 🦕 fossil fuel infrastructure, becoming the first in the US to pass such a measure.

The ordinance prohibits the construction of new refineries or coal facilities and places more restrictions on expansion of fossil fuel facilities at Cherry Point, such as requiring offsets for greenhouse gases emitted from any expansions and rigorous environmental review.

Whatcom is currently polluted by two of Washington’s five oil refineries, and five years ago saw the cancellation of the country’s largest planned coal export facility due to concerns from the Lummi Tribe around fishing treaty rights. “What's been happening in Whatcom County for the last 10 years and in the state and Oregon is that people have been saying no to these new proposals coming forward one by one by one,” said Matt Krogh, director of the Safe Cities campaign for Stand.earth. “And people are winning.”

With less than a hundred days to Glasgow, it seems the planet is trying to tell us something. Heatwaves, forest fires and devastating 🌊 floods occupy the news every day. The record for the highest temperature ever reliably recorded on Earth was broken, again. The climate crisis is upon us, and to credibly address the problem, banks need to come forward before Glasgow with commitments to reduce their fossil fuel financing rapidly.

This is not only our view, but the view of asset managers worth $4.2 trillion, who wrote to banks this month. And it is in line with what Dr. Fatih Birol of the IEA told the UK government last week. Moves like Intesa Sanpaolo's this month, which refer to fossil gas as a "low carbon alternative", are not going to cut it. While their new policy contains some steps forward, we've passed the point where we can applaud baby steps that leave space for financing new fossil fuel projects that will make this crisis worse.

Thankfully, there is a global movement working to get the message across to banks everywhere. Earlier this year, BankTrack launched fossilbanks.org, a platform that aims to support this movement and profile the many campaigns targeting "fossil banks" globally. Activists Halt Mountain Valley 🦕 Pipeline Construction

Environmental activists temporarily shut down construction of the already over-budget and behind schedule Mountain Valley Pipeline in southwestern Virginia on Monday.

Organizers with the group Appalachians Against Pipelines said 10 people locked themselves to construction equipment to protect native species threatened by the controversial pipeline that would carry fracked gas — primarily methane — more than 300 miles from West Virginia to southern Virginia. “Right now we’re looking at a future with extreme water shortages, accelerating difficulty in growing food, mass human displacement due to natural disasters and manmade disasters caused by pipelines like these,” said Mandy, one of the protesters.

The temporary construction comes as activists across the state are ramping up pressure to block the pipeline. (WDBJ, WSLS)

'A Large Domino To Fall' — Harvard To Shed Fossil Fuels 🦖 Investments

Harvard University will divest its $41 billion endowment from 🦖 fossil fuels, citing the financial imprudence of those investments, its leadership announced late last week. The move from the nation's oldest university, with the largest university endowment, is a dramatic turn in the years-long battle between the administration and organizers both on- and off-campus.

The university's statement did not set a timeline, nor use the words "divest" or "divestment," but activists are taking the win. “So long as Harvard follows through, this is divestment,” Connor Chung ’23, a Divest Harvard organizer, told the Crimson. “This is what they told us for a decade they couldn’t do, and today, the students, faculty, and alumni have been vindicated.”

Harvard's announcement could have greater implications than just its sizable endowment. “The fact that Harvard is finally indicating that it is no longer supporting the fossil fuel community is a large domino to fall,” Danielle Strasburger, a 2018 Harvard graduate who co-founded an alumni divestment movement, told the New York Times. "Hopefully this will encourage other universities to put the pressure on those who haven’t yet.”

Attorney General TJ Donovan announces lawsuit against 🦖👿🦕 oil giants

Vermont Attorney General TJ Donovan announced Tuesday the state has filed a lawsuit against the four largest suppliers of 🦖 fossil fuels in Vermont, arguing the companies have misled consumers about their products’ contribution to climate change.

The state is seeking to force the companies to include stickers or labels at gas pumps warning Vermonters about the products’ impact on the environment, in addition to fines and other measures.

“Here’s the thing: We’re not saying, ‘Don’t sell your product in Vermont.’ We’re not saying, ‘Vermonters, don’t drive,’” Donovan said at a press conference outside Chittenden County Superior Court in Burlington. “We are simply saying that Vermonters have the right to know.”

The consumer protection suit claims that 🦖 Exxon, 🦕 Shell, 🦖 Sunoco and 🦕 CITGO have made “past and ongoing violations” of Vermont’s Consumer Protection Act via “numerous deceptive acts and unfair practices in connection with their marketing, distribution, and sale of gasoline and other fossil fuel products” in the state.

The state alleges that these companies have done so in three ways:

👉 through historical knowledge that their products contribute to climate change,

👉 by releasing false advertisements that downplay their products’ impact on the environment and

👉 by “greenwashing” campaigns that suggest they are helping address the problem.
   

The lawsuit calls for “disclosure at the point of sale,” which could take the form of the stickers or labels at gas pumps, said Peter McDougall, chief of the Environmental Protection Division in the Vermont Attorney General’s Office.

“While the products are legal, they are not innocuous,” Assistant Attorney General Justin Kolber said. “This is no different than any other countless consumer products that carry disclosures with them.” ... ...

The lawsuit alleges that the 🦖 defendants have known their fossil fuels have contributed to climate change since the 1960s. The complaint cites internal reports conducted on behalf of the defendants, such as one from Shell in 1988 that said fossil fuels are “the primary driver of climate change,” and by the time global warming is detected, “it could be too late to reduce the effects.”

Meanwhile, according to the lawsuit, the companies used false advertising to downplay the impact. At the press conference, Kolber shared a 1988 internal memo from Exxon that said the company should 😈 “emphasize uncertainty around climate science and turn it into a debate,” which was followed by such advertisements in the 1990s.

LA County Votes To End 🦕 Drilling

Los Angeles County supervisors on Wednesday voted to ban drilling in unincorporated areas and to phase out oil and gas drilling. There are currently 1,046 active wells, 637 idle wells, and 2,731 abandoned wells in unincorporated areas of the nation's most populous county. according to a memo to the board dated June 3, 2021.

County Supervisor Janice Hahn praised the plan as "a framework for how we transition from dirty fossil fuels to clean energy and make sure we bring our labor partners with us." The Board also voted to create a program to ensure that wells are properly closed and cleaned up, and to expand the county's task force focused on a just transition for fossil fuel workers and communities. United Kingdom announces target of 100% clean energy by 2035

Prime Minister Boris Johnson said that this target could be achieved through investments in offshore wind and other renewable energy sources.

The announcement comes on the heels of the country’s phaseout of new 🦖 gas car sales by 2030 , and as it pursues energy independence amid worldwide volatility in energy markets. (BBC)

Google and YouTube Take A Small Step Towards Protecting Users From Climate Disinformation, Which May Reduce Anti-Semitism Too

Last week, Google announced that they would no longer allow climate denial ads , and that YouTube would demonetize climate denial content. This is a small but serious win, particularly for the advertisers who don’t want their ads running next to toxic climate denial content

Deniers , of course, freaked out about it. For example, 🦖 Matt Vespa at TownHall wrote climate denial is not “something that truly goes against acts and reality, like Holocaust denialism.”   

Which is funny, because literal Holocaust denier 👿 Peter “Sweden” Imanuelsen, who is increasingly dabbling in climate denial, tweeted that this “climate change censorship” is the “first step,” after which comes “climate change lockdowns” and “finally climate change passports.” 

Yes, because not being able to make money lying to people is just one small slippery slope away from “climate change passports,” which … aren’t a thing. 

Meanwhile, 🐍 Anthony Watts posted on Friday that he’s holding an essay contest with $1,000 prizes for winners. The catch? Well, because “over the past two years Google has slowly squeezed out most of our ad revenue,” first he has “to raise the funds so we can offer meaningful cash prizes. That means folks like you need to help. Please go to our donation page and contribute as much as you can.” 🙃

What a great deal! First, give as much of your money to 😈 Watts as you can. Then, write a 1,500 word essay with “the best arguments against the theory of man-made catastrophic global warming that would convince your neighbors that there is no climate crisis,” and get a shot at winning your money back! 

Watts may want to have a chat with his fellow deniers though, because over at JunkScience dot com, the website that bears the name of Steve Milloy’s early pro-tobacco lobbying, Milloy actually wrote it off as no big deal, and he may be somewhat right. He says that “if what we were saying was wrong, we would have been laughed off the Internet long ago,” which is sort of true, as one conservative pundit attempted to “gotcha” outlets like PBS, CBS and the Boston Globe for interviewing deniers nine, 11, and 11 years ago. Why nothing more recent? Probably because deniers have been laughed out of mainstream media, for obvious reasons. 

More seriously, 🦖 Milloy wrote that “Google’s move will have no effect on climate realist web sites for the simple reason that the ad revenue is pretty trivial. We don’t know of any climate realist who blogs for the Google ad revenue.” Again, probably pretty true, because 🐍 deniers like Milloy are paid by the 🦖 industry directly, not ad revenue, and while Watts long (claimed) he wasn’t funded by 🦖 Big Oil, he’s employed by the 🦕 Heartland Institute these days, so while his site might be hurting for ad revenue, we probably don’t need to pass the collection plate around for him quite yet!

Milloy then decided to conclude his post with the claim that deniers like himself are “winning… with or without a few shekels from Google,” because either Milloy thinks ad revenue is payed in the currency of Isreal and he was using the term literally, or he deployed a classic anti-semitic dog whistle because he’s exactly the sort of 👿 person the world would be better off never hearing from again. 

So Vespa may be right, in that climate denial isn’t quite as ghoulish as Holocaust denial. But the Venn diagram of Holocaust deniers and climate deniers may be close enough to a circle to make any distinction meaningless.

As last coal chimney falls, will green energy issue in Scotland break up the United Kingdom?

Scotland’s first minister, Nicola Sturgeon of the Scottish National Party, pushed the button last week that brought down the country’s tallest structure, the chimney of the massive coal plant at Fife. The plant was decommissioned in 2016, as Scotland replaced coal with renewables for electricity generation, but the demolition was symbolic of the passing of an age. The steam engine was invented in Scotland, a hungry monster that demanded so much fuel that it contributed to deforestation in Great Britain before people turned to coal. Scotland put billions of tons of carbon dioxide into the atmosphere in the subsequent two centuries.

In 2020, however, Greg Russell of The National reports, 97% of Scotland’s electricity came from renewables , accounting for just over a third of the country’s energy use. Russell also notes that the Scottish government plan has been to get 60% of electricity from onshore wind, about 11% from offshore wind, and 18% from hydro, with 8% coming from other sources, including solar.

Ominously, however, Russell quotes SNP Natalie Don as saying,

Sturgeon’s government intends to get 50% of Scotland’s over-all energy from renewables by 2030, though Scottish environmentalists 👍 complain that this goal is not bold enough.

“Scottish Renewables” reports that there are plans to get an additional 11 gigwatts from onshore wind and a 12 gigawatts from offshore wind by 2030, Scotland isn’t great for solar much of the year, but there are plans for an additional gigawatt of solar, which will mainly be used in the long summer days. The country is seeking another gigawatt from wave and tidal energy.

Regarding offshore wind, a new 10 megawatt fixed bottom wind tower has just been installed off the coast of Scotland at the 1 gigawatt Seagrass facility.

Exxon Refinery In Norway Closes Down



Agelbert COMMENT: EVs will destroy the hydrocarbon "Industry" because of the not so secret fact that all the other "products" that come out of a refinery do not amount to a hill of beans in profit. Pharmaceuticals, fertilizers, plastics, synthetic rubber chemicals and lubricants are insignificant compared to fuels. Just look up how a "barrel of crude" is broken down in output. 

They can't go back to the days of Rockefeller (before car fuels) in the 19th century when he would poison horses and cows downstream of his refinery by dumping "non-lubricant waste products" (i.e. benzene and other carcinogenic hydrocarbon crap) in the nearby river.

ALL those "lighter products" coming out of the cracking towers ARE HAZARDOUS WASTE. The hydrocarbon industry has NO PLAN WHATSOEVER to fund the proper handling and disposal of these toxic refinery products, as we all have observed by their habit of flaring any "incovenient" hydrocarbons at all fracking sites and all refineries.

They just DO NOT CARE what we-the-people are assaulted with. They never have and never will. 

No 🦖 fuel sales, no 💰 profitable hydrocarbon industry "business model", PERIOD.

The sooner these crooks and liars go bankrupt, the better for all of us, including even them!

The Biden administration will suspend new federal oil and gas leasing

The move was made in response to a recent 🦖😈 federal court ruling that prevents the government from considering the societal cost of carbon emissions in major decisions.

A litany of federal climate rules have been on hold while the Justice Department appeals. The Interior Department 👍 put the brakes on a lease sale for drilling across nearly 180 thousand acres in Wyoming—one of the 10  🐘 Republican- 🦕 led states that initiated the lawsuit complaining about the carbon metric used by the Biden administration in calculating the costs and benefits of agency decisions.

Amit Narang 🗽 with Public Citizen told the New York Times the decision by the Trump-appointed federal judge is “embarrassing” and “a 🦖 partisan political hit job dressed up as a legal opinion.” (New York Times $, Washington Post $, CNN, The Hill)

Canadian Campaign Demonstrates Big Oil Disinfo As ExxonMobils’ Free Speech Defense Flounders In Court

Last Thursday, the Guardian reported on findings from Eco-Bot.Net that reveal the latest case of industry woke-washing, and specifically, “Indigenous-washing,” one of many ad campaigns from TC Energy that falsely present it as being widely supported by the Wet’suwet’en people who are fiercely protesting 👍 the company’s ☠️ pipeline construction.

And it’s clearly used as a strategic weapon, as TC Energy is not merely touting their product but also ramping up ads in the wake of major news moments involving the arrest of land defenders at protests and in violent raids. (The 🦍 law enforcement officials involved in these arrests have been formally accused of violating the UN Declaration on the Rights of Indigenous Peoples.

This tracks with standard industry behavior, disinfo researcher Geoffrey Supran told the Guardian. “The upticks in industry spending on ads directed at specific demographics and coinciding with protests appear to be classic examples of financially motivated, politically oriented, micro-targeted public affairs campaigns. There are no better predictors of fossil fuel industry ad spending than political action and media attention, and this data appears to be a case in point.”

The good news is that the years-long slog to hold the industry accountable for its false advertising took a step forward recently, when a judge ruled that Honolulu’s case should remain in state court, denying Big Oil’s request to move it to a federal court where the defendants thought they would get a more favorable hearing. 

Elsewhere, Big Oil is facing similarly tough times in court. For example, ExxonMobil’s argument that these cases are an infringement on the company’s First Amendment right to free speech was shut down by a Texas court in late Feb. And then last week, Emily Sanders at ExxonKnews could barely contain her glee at how two Massachusetts Supreme Court justices scrutinized the company’s argument in a case brought by Mass AG Maura Healy. The justices compared Exxon to a tobacco company, which was the last thing its lawyers wanted to hear.

Much like the tobacco industry, the oil industry has engaged in a decades-long false advertising campaign.
And not just the one to deceive the public about the serious risks posed by their product, but also to begin setting up this entire defense that climate disinfo is merely “free speech.” 

Amy Westervelt uncovered the history at the Guardian, with “never before published internal documents from 🦖 Mobil Oil reveal that company executives created the framework of corporate free 😈 speech back in the late 1960s and early 1970s. The argument arose out of a situation, not unlike the one playing out today, with war driving up prices at the pump and oil companies wanting desperately to change the public’s perception of their industry.”
Westervelt traces the industry’s (false) advertising history building the corporate free speech argument through to its ultimate unleashing with the 2010 Citizens United ruling, which “which opened the floodgates on corporate spending” and “blurred the line between commercial speech – a marketing message from a company to the public – and political speech, which up until Citizens United was connected only to funding or speech backing a particular candidate or policy.” 

And now they’re using that same defense in court, but as University of Oklahoma professor Robert Kerr told Westervelt, they face long odds because “it’s really deeply established even by some of the members of the current Supreme Court, that
the First Amendment will never protect expression that is fraud.So assuming this conservative-majority court sticks to the conservative legal deference to well-established precedent, it should be a losing gambit for ExxonMobil. 

Unfortunately, Kerr added, “with this Court there seems to be a majority that wants to say, 'Yes' to almost any question the corporate interests raise.”  🥺

Federal Court Rejects Exxon’s Attempt to Halt Climate Change Investigations

On Tuesday, a federal appeals court denied ExxonMobil’s attempt to stop the attorneys general of New York and Massachusetts from investigating whether the company lied about its knowledge of climate change.

The decision was handed down by the 2nd U.S. Circuit Court of Appeals in Manhattan, which said Exxon couldn’t sue Massachusetts’ Attorney General Maura Healey because it was already doing so in the state court system, as reported by Reuters.

The U.S. District Court for the Southern District of New York rejected a 2018 lawsuit Exxon had filed against New York, claiming the state violated the company’s rights for its investigations.

ExxonMobil first sued New York and Massachusetts in 2016, when it received subpoenas for shareholder communications and documents related to climate change. The company has since tried to prevent the two states from moving forward with the investigation.

“During the pendency of this appeal, the New York Attorney General closed the New York investigation and commenced an enforcement action, which resolved in Exxon’s favor and is not being appealed by the state. Because these events have mooted Exxon’s claims against the New York Attorney General, we lack jurisdiction over those claims,” the court explained in its decision. “As to Exxon’s claims against the Massachusetts Attorney General, Exxon could have pursued the relief it now seeks in an earlier Massachusetts state court proceeding arising from the same events that underlie the present suit; its claims against the Massachusetts Attorney General are thus barred under the doctrine of res judicata.”

The oil giant wanted to appeal the lower court decisions to revive the case, ultimately to have its documents that had been given to New York for the state investigation either returned or destroyed. The new decision stops Exxon’s attempt to prevent these investigations.

“We are pleased with the Second Circuit’s decision today, which rejected Exxon Mobil’s baseless attempts to challenge state law enforcement efforts,” New York Attorney General Letitia James said. “We will continue our efforts to protect New York consumers and investors from any harm or deceit.”

Chloe Gotsis, spokeswoman for Healey, said their office looks forward to obtaining the required documents and continuing the investigation.

This is just one of many lawsuits Exxon has been facing, as it has tried to minimize how its fossil fuel products impact climate change to boost profits and assure investors.
